Terms of Service — BlueArc Apps

Please read these Terms of Service (“Terms”) carefully before downloading or using any application made available by BlueArc Labs (“we,” “us,” or “our”).
By downloading, installing, or using any of our applications — Analog Mix, Cakepan Scale, Chat Memoria Pro, Docusnap, Shield Snap, or NightShift Nurse — you agree to be bound by these Terms. If you do not agree, do not use our apps.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for your personal, non-commercial purposes strictly in accordance with these Terms.
2. Restrictions
You may not: (a) copy, modify, or distribute the app; (b) reverse engineer or attempt to extract the source code; (c) sublicense or sell the app; (d) use the app for any unlawful purpose.
3. User-Generated Content & Data
Our apps process data exclusively on your local device. We do not upload, collect, or store your personal content on our servers. You retain full ownership of all content you create within our apps.
Exception — NightShift Nurse: Version 3.0+ offers optional cloud sync features using Google Firebase. By enabling cloud sync, you consent to your roster data being stored securely on Firebase servers solely to provide the sync feature.
4. In-App Purchases
Some apps offer optional premium features via in-app purchases. All purchases are processed by Apple App Store or Google Play Store. We do not store your payment details. All purchases are final, subject to each platform’s refund policy.
5. Disclaimer of Warranties
Our apps are provided “AS IS” and “AS AVAILABLE” without warranty of any kind. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall BlueArc Labs be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
7. Termination
We may terminate or suspend your access to our apps immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the app will immediately cease.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the “Last Updated” date. Your continued use of our apps after any changes constitutes your acceptance of the new Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable local laws, without regard to conflict of law provisions.
